1. Application
Each order is considered an acceptance by the purchaser of our terms and conditions, which are an integral part of the agreement , to the exclusion of any other general or specific terms and conditions of the buyer, unless otherwise expressly agreed in writing.
2. Quotes and acceptance of orders
All our offers are without engagement. We are only bound by an order after we have confirmed in writing or after we have begun to implement. The information about the products and pricing, as well as the detailed order information, have been prepared and distributed subject to modification and correction.
3. Delivery
Products are delivered only in the countries where the site permits the delivery. The delivery of products will, to the extent possible, happen within the time stated in the individual order confirmation. Incorrect delivery addresses are the responsibility of the buyer and may lead to additional costs. Unless otherwise stated, prices do not include transportation and delivery of the goods. The costs of transport and delivery are listed separately. The delivery times are not binding, but are only given as an indication. No delay in delivery may lead to termination of the purchase or payment of damages in favor of the buyer, except in cases of intentional delay. We are entitled to perform partial deliveries. In case of non-delivery of the goods, the sums paid by the buyer will be repaid without interest or other compensation.
4. Retention of title
The delivered goods remain our property until full payment of the price, including all fees and charges, interest and fees. In case of non-payment, we reserve the right to take the goods legally and at the expense of the buyer.
5. Complaints
Complaints need, to be admissible, to come to us: (a) in case of complaint for nonconforming delivery, eight (8) days after delivery and (b) in case of hidden defects, eight (8) days after discovery of the defect or after the time that such a discovery could reasonably happen. The receipt of the goods by the buyer covers every possible defect or nonconformity which could then be determined.
6. Warranty
Our warranty is limited to the warranty for hidden defects and the warranty in the case of consumer purchases, as stipulated in the Civil Code. We are only responsible for damage caused by intent or gross negligence. We are not liable for any indirect damages of any nature suffered by the purchaser.
7. Renunciation
The distance selling to consumers that are within the scope of the Act of 6 April 2010, the consumer has the right to inform the seller that he renounces the purchase without penalty and without giving any motif within fourteen calendar days from the day following the delivery. Should the customer wish to appeal to this, he must return the goods in original condition and packaging at own risk and expense to Something Naais, Fabriekstraat 80, 9200 Baasrode (Dendermonde), Belgium. Goods that are specifically designed for the buyer, or goods that spoil easily can not be returned and the buyer can not rely on the stipulation.
8. Force majeure
We are not liable for any delay in performance or non-performance of our obligations due to events beyond our normal control, including production interruptions, difficulties or shortages of raw materials, labor, energy or transport or delays in transportation, strikes, lockouts, work stoppages or other collective labor disputes, either concerning ourselves or our suppliers, even if those events are foreseeable.
9. Prices and Payment
The prices include VAT but exclude shipping costs. The costs are calculated at checkout based on the weight of your order.
10. Personal data
By ordering on the website Something Naais, expressly allows the buyer to proceed with the processing and use of their personal data for purposes such as client administration, order management, deliveries and invoices, monitoring of solvency, marketing and advertising. The processing for marketing and personalized advertising happens only if the customer expressly agreed during the order process. Something Naais will not transfer personal information to third parties. The buyer has the right to access all data and improvement. The buyer shall at all times have the right to object free of charge to oppose the processing for direct marketing purposes. 11. Evidence
All parties accept, in the context of their relationships, electronic evidence (eg e-mail, backups ...).
12. Color
The colors of the products may differ from the actual color. Products can not be returned due to color deviation.
13. Severability
If any section of these terms and conditions is declared invalid, such invalidity shall not affect the validity of the remaining sections.
14. Governing law
All agreements concluded with the seller are governed by Belgian law. The Belgian courts have exclusive jurisdiction.
